Many argue that its registration is a better option for state assistance than a social package of services.

But is it really so? If a person is a disabled person of group 1, how can he apply for a EDV? What documents do you need to provide and where? And in general, what is the amount of this EDV for a disabled person of the 1st group?

Legislative regulation

The issue of payments of the single income tax for disabled people of the 1st group is regulated by such legislative acts:

  1. Federal Law No. 122-FZ, which provides for the possibility of monetization;
  2. Federal Law No. 181-FZ, which provides for social protection for disabled people living in the territory of the Russian Federation.

In addition, there is also a Decree of the Government of the Russian Federation, which guarantees the provision of state support for all categories of people with disabilities.

Terms of accrual

In order to receive the EDV, disabled people of the 1st group need only apply to the Pension Fund at their place of residence before October 1 of the current year and, in addition to the application, provide the necessary list of documents.

But, it is not uncommon that there are cases when a disabled person wants to return a social package of services instead of a EDV. In this case, the procedure for issuing is completely similar to obtaining a UDV. In simple terms, a disabled person will be able to return a set of social services for himself only from next year.

Example: in 2018, a disabled person received a EVD, but he wants to return the social package of services for himself instead. Accordingly, before October 1, 2018, he applies to the Pension Fund and writes the necessary application. Since January 2019, instead of the EDV, he has been provided with a social package of services.

Payout amount

According to the current Federal Law No. 122-FZ, the definition of UDV means a monthly cash supplement to pension provision, which can be increased due to the refusal of the social package of services.

SOCIAL SERVICE SET (NSO)

The set of social services includes:

providing, if there are medical indications, a voucher for sanatorium treatment - 133.61 rubles;
free travel on suburban railway transport, as well as on intercity transport to the place of treatment and back - 124.05 rubles.

When providing social services, citizens with group I disability and disabled children have the right to receive, under the same conditions, a second voucher for sanatorium treatment and free travel on suburban railway transport, as well as on intercity transport to the place of treatment and back for person accompanying them.

In order to refuse to receive a set of social services in kind and receive funds, it is necessary to submit an application for refusal to receive social services or one social service to the territorial body of the Pension Fund of the Russian Federation before October 1.

It is enough to submit an application for waiving in-kind benefits once, after which there is no need to confirm your decision annually.

The waiver submitted will remain in effect until the citizen decides to resume receiving benefits.

ADDITIONAL MONTHLY SUPPORT (DEMO)

Only citizens of the Russian Federation are eligible for DEMO, regardless of their place of residence. DEMO in the amount of 1000 rubles is set:

Disabled people and participants of the Great Patriotic War;
disabled due to military trauma;
former juvenile prisoners of concentration camps, ghettos and other places of detention.

DEMO in the amount of 500 rubles is set:

Military personnel who served in military units, institutions, military educational institutions that were not part of the army in the period from June 22, 1941 to September 3, 1945 for at least six months, as well as military personnel awarded orders or medals of the USSR for service during the specified period;
widows of servicemen who died during the war; widows of invalids of the Great Patriotic War;
persons awarded the badge Resident of besieged Leningrad
former adult prisoners of Nazi concentration camps, prisons and ghettos.

DEMO is paid by the territorial body of the Pension Fund at the same time as the pension.

Citizens who have the right to DEMO, but who have not implemented it in a timely manner, must submit an application for the appointment of this payment to the territorial body of the PFR at the place of residence. If a citizen is entitled to a DEMO, but he is not a pensioner, this payment is also assigned and paid by the territorial bodies of the PFR at the place of residence, and in the case of permanent residence outside of Russia, by the Pension Fund of the Russian Federation. If a citizen simultaneously has the right to receive a DEMO for several reasons, it is established on one basis, providing for a higher amount of payment.

FEDERAL SOCIAL SUPPLEMENT (FSD)

This pension supplement is established for all non-working pensioners whose total material income is below the subsistence level established in the region.

First-time pensioners can apply for a supplement at the same time. And it will be paid to the citizen automatically along with the basic pension.

As for current pensioners, whose material security is below 4,700 rubles, you need to apply for the appointment of the FSD to your territorial body of the Pension Fund. The pensioner will receive the additional payment from the 1st day of the month following the month of applying for it. So, those who applied in April, it will be installed from May 1, and so on.

Many pensioners are mistaken, believing that the concept of "material security" includes only the pension that they receive in their hands in the form of money. This is wrong.

The social supplement is established not only for the pension of the elderly, but also for the pension of disabled children and children under the age of 18 who have been assigned a survivor's pension. The surcharge is set automatically on a non-declared basis.

The procedure for exercising the right to receive and refuse NSO

To receive a set of social services, you must contact the territorial body of the Pension Fund of the Russian Federation. The date of emergence of the right to receive NSI is the date of appointment of a monthly cash payment to a citizen. The set of social services (NSO) includes the following services:

3. Free travel on suburban railway transport, as well as free travel on intercity transport to the place of treatment and back.

Citizens receiving a set of social services may refuse to receive it:

    fully;

    or only from medicines (reserving the right to use the services of sanatorium treatment and free travel as part of a set of social services);

    or only from spa treatment (reserving the right to use the services for the provision of medicines and free travel as part of a set of social services);

    or from free travel (reserving the right to use the services for the provision of medicines and spa treatment as part of a set of social services);

    or from free medicines and spa treatment at the same time (reserving the right to use free travel as part of a set of social services);

    or from free medicines and travel at the same time (reserving the right to use the services of spa treatment as part of a set of social services);

    or from free travel and spa treatment at the same time (reserving the right to use the services for the provision of medicines as part of a set of social services).

An application for the next year is submitted by a citizen to the territorial body of the Pension Fund of the Russian Federation before October 1 of the current year and is valid until December 31 of the year in which the citizen applies for (social services). In the Voronezh region as of December 1, 2014, 67,868 federal beneficiaries are entitled to a set of social services, in accordance with the applications of which 34,179 certificates of entitlement to NSI were issued.

July 20, 2014 the Administrative Regulations for the provision by the Pension Fund of the Russian Federation of a public service to inform citizens about the provision of state social assistance in the form of a set of social services, approved by order of the Ministry of Labor of Russia dated 14.01.2014 N 3n (hereinafter referred to as the Regulations), came into force.

On State Guarantees and Compensations for Persons Working and Living in the Far North and Equivalent Areas.

21.07.2014 . The President of the Russian Federation signed Federal Law No. 231-FZ “On Amending Articles 4 and 35 of the Law of the Russian Federation “On State Guarantees and Compensations for Persons Working and Living in the Far North and Equivalent Areas”.

This Federal Law provides for compensation of expenses for paying the cost of travel and the cost of carrying luggage to a new place of residence, namely, citizens who do not work under labor contracts, who are recipients of labor pensions and (or) state pensions and members of their families who are on their dependency, in case of moving from the regions of the Far North and areas equated to them to a new place of residence on the territory of the Russian Federation, which is not related to these areas.

This Federal Law will apply to legal relations that have arisen since May 16, 2013.

The amount, conditions and procedure for reimbursement of expenses associated with moving from the regions of the Far North and equivalent areas are established by the Government of the Russian Federation.

The rules for compensating expenses for paying the fare and the cost of carrying baggage associated with the relocation of pensioners from the regions of the Far North and equivalent areas to a new place of residence on the territory of the Russian Federation that is not related to the indicated areas and localities should be adopted by the Government of the Russian Federation.

Compensation for travel expenses and the cost of baggage transportation will be carried out by the territorial body of the Pension Fund of the Russian Federation at the new place of residence after the Rules for compensation and expenses are approved.

On compensation for expenses incurred by non-working pensioners when moving from the regions of the Far North and equivalent areas

In July 2014, Federal Law No. 231-FZ "On Amendments to Articles 4 and 35 of the Law of the Russian Federation "On State Guarantees and Compensations for Persons Working and Living in the Far North and Equivalent Areas", which secured the right to compensation for travel expenses and the cost of baggage transportation to a new place of residence for non-working pensioners and their dependent family members, in case of moving from the Far North and equivalent areas to a new place of residence on the territory of the Russian Federation that is not related to these areas.

Compensation for these expenses is carried out at the expense of budgetary appropriations provided from the federal budget in the form of interbudgetary transfers to the budget of the Pension Fund of the Russian Federation.

This Federal Law applies to legal relations that have arisen since May 16, 2013.

The amount, conditions and procedure for compensating expenses associated with moving from the regions of the Far North and equivalent areas are established by the Government of the Russian Federation in Decree No. 1351 dated 12/11/2014. "On the procedure for compensating expenses associated with moving from the regions of the Far North and areas equated to them to persons who are recipients of insurance pensions and (or) state social security pensions, members of their families."

A pensioner who has made the move must register for retirement with the Pension Fund Office at the new place of residence. After the pension case is registered, you can apply for compensation with documents confirming the travel and baggage expenses incurred.

Since the beginning of the implementation of these legal norms, 521 people have applied for compensation in the territory of the Voronezh region, almost 15 million rubles have been transferred to the recipients' accounts.

About the monthly cash payment for May 2019

The territorial bodies of the Pension Fund of the region continue to make monthly cash payments and reimbursement of funds to pay for the cost of a set of social services (social package) to federal beneficiaries in accordance with the Federal Law, which replaced benefits in kind with cash payments.

In accordance with the law, the PFR Branch for the Voronezh Region maintains the regional segment of the Federal Register of persons entitled to receive state social assistance, the so-called federal beneficiaries. As of May 1, 2019, 287,590 beneficiaries were included in its composition.

As part of the register:

  • disabled people - 214,381 people, 74.54% of the total number of federal beneficiaries;
  • persons under the law "On Veterans" - 32,615 people, 11% of the total number of federal beneficiaries;
  • juvenile prisoners - 15,698 people, 5.46% of the total number of federal beneficiaries;
  • citizens exposed to radiation - 25,896 people, 9% of the total number of federal beneficiaries.

The composition of the register is constantly changing - replenished with new beneficiaries and reduced by deceased persons or those who have lost the right to benefits. In 2019, more than 5,000 beneficiaries were included in the regional segment of the Federal Register.

As of May 01, 2019 44 beneficiaries from among the Heroes are registered in the region ...:

In accordance with the law, citizens who are entitled to state social assistance in the form of a monthly cash payment and a set of social services may refuse to receive a social package.

Starting from January 1, 2009, the procedure for refusing to receive social services has been simplified. If in the period from 2008 to 2018 the beneficiary submitted an application for refusing to receive a set of social services, and the beneficiary retained the desire to receive the cash equivalent in subsequent years, then there is no need to re-apply to the Pension Fund of the Russian Federation. If the beneficiary has changed his mind and wants to use the set of social services in kind again from January 1 of the next year, then before October 1 of the current year, an appropriate application should be submitted to the territorial body of the Pension Fund at the place where the monthly cash payment is received.

Taking into account the statements of citizens who refused a set of social services (hereinafter referred to as NSO) in 2008-2018, the number of beneficiaries who do not use in-kind benefits in 2019 reached 234,288 people, which is 81.41% of the total number of beneficiaries ( 287 590) included in the register. At the same time, as of May 1, 2019, 62,167 federal beneficiaries are entitled to social services in kind.

To pay for the provision of a set of social services to a citizen, 1,121.42 rubles are provided. per month, including: to pay for social services, in the form of free medicines according to doctor's prescriptions - 863 rubles. 75 kopecks; to pay for a social service, in the form of a free sanatorium and resort voucher - 133 rubles. 62 kopecks; to pay for social services, in the form of free travel - 124 rubles. 05 kop.

On the results of the refusal of federal beneficiaries from social services for 2019

As of October 1, 2018, 289,484 citizens were registered in the bodies of the Pension Fund of the Russian Federation in the Voronezh Region, belonging to the category of federal beneficiaries in accordance with the Federal Law of August 22, 2004. No. 122-FZ. These citizens are entitled to receive monthly cash payments and social assistance in the form of a set of social services.

The set of social services consists of three parts:

Federal legislation provides for the beneficiary the right to choose whether to receive social services in kind or in cash. It is allowed to replace a set of social services with money in whole or in part. This year, the territorial bodies of the Pension Fund of the region accepted 14,705 applications for refusing a set of social services. Taking into account the statements of citizens who abandoned the NSI in 2008-2018, the number of beneficiaries who will not use in-kind benefits in 2019 is 84% ​​of the total number of beneficiaries (289,484) included in the register.

At the same time, 1,140 people applied for the resumption of the provision of a set of social services this year.

In 2019, 55,850 beneficiaries will receive assistance in the form of a set of social services in the Voronezh Region.

In the Russian Federation, there are certain categories of citizens who are entitled to receive a monthly cash payment - a special type of social support for people who have an additional preferential status, confirmed by relevant certificates and documents. This social payment appeared as a result of the so-called "monetization of benefits", when people were given the right to choose whether to receive benefits in kind or in cash.

What is EDV

A new subsidy in the Russian Federation arose with the adoption of the federal law of August 22, 2004 N 122-FZ. Its essence was to give a citizen entitled to a benefit the opportunity to choose whether to receive subsidies in cash or in another format (for example, residents of rural areas would not need free travel).

According to the law, when replacing benefits in kind with cash compensation, it was supposed to introduce effective legal mechanisms to ensure the preservation and possible increase in the previously achieved level of social protection of citizens, taking into account the specifics of the legal, property status and other circumstances

The single payment is formed from the federal budget and does not depend on the actual establishment of pension provision. For each category of federal beneficiaries, the amount of payments in the corresponding year is established by the Government of the Russian Federation. Each region has the right to expand the list of privileged categories, in which case payments to regional beneficiaries are made from the budgets of the constituent entities of the Russian Federation.

Payments are governed by federal, state and local laws. There is no unified federal law on EDV in Russia, the regulatory framework is formed from the following legislative acts:

    Federal Law No. 5-FZ of January 12, 1995, applicable to certain groups of veterans;

    federal law No. 181-FZ of November 24, 1995, used for persons who have a confirmed disability status;

    Law of the Russian Federation No. 1244-1 dated May 15, 1991, applicable to citizens affected by the accident at the Chernobyl nuclear power plant (Chernobyl nuclear power plant);

    federal law No. 2-FZ of 01/10/2002, used for persons who suffered during tests at the Semipalatinsk test site;

    Federal Law No. 175-FZ dated 11/26/1998 applied to citizens who participated in the aftermath of an accident that occurred at the Mayak production association, and persons exposed to radiation due to the discharge of radioactive components into the Techa River.

    Federal Law No. 5-FZ of January 9, 1997 and Law of the Russian Federation No. 4301 of January 15, 1993, used for persons who received certain state awards or were noted for special services to their homeland.

Who is supposed to

Monthly cash payment is provided to the following categories of citizens of the Russian Federation:

    veterans of the Great Patriotic War or other military operations;

    persons with disabilities, including children with disabilities;

    former prisoners of fascism who were minors during the German occupation;

    persons who were exposed to radiation during accidents, became victims of man-made disasters or the result of tests of nuclear, atomic and chemical weapons (they are called disabled Chernobyl), and workers who were involved in the elimination of the consequences of the accident at the Chernobyl nuclear power plant, on the Techa River and the Mayak production association ";

    citizens awarded the title of Hero of the USSR or the Russian Federation or holder of the Order of Glory of three degrees;

    family members of dead citizens who received the title of Hero or full cavalier of the Order of Glory. Widow or widower, parents, children under and over 18 years of age (if they received a disability before the age of majority), up to 23 years of age with full-time education in a college or institute;

    heroes of socialist labor;

  • persons awarded with the badge "Inhabitant of besieged Leningrad".
  • Conditions for the appointment of EDV in 2018

    Establishment of UDV for beneficiaries in 2018 is carried out on one basis. If a citizen has the right to receive a payment on several grounds limited by one law, then he will be granted a payment on the basis with a larger amount. If there is a right to a single tax on the basis of several laws or other regulatory legal act, a citizen can count on one annual payment from the list (you can choose which one).

    Exceptions are citizens who have the right to receive payments on the basis of laws:

      No. 1244-1 "On the social protection of citizens who were exposed to radiation as a result of the accident that occurred on the territory of the Chernobyl nuclear power plant";

      No. 4301-1 "On the status of the heroes of the Soviet Union, Heroes of the Russian Federation, and full holders of the Order of Glory";

      No. 5-FZ "On the provision of social guarantees to the Heroes of Socialist Labor, Heroes of Labor of the Russian Federation and full holders of the Order of Labor Glory".

    They can be paid at the same time and on a different basis.

    Combat veterans

    The list of categories of persons with the status of "combat veterans" is given in Article 3 of the federal law "On Veterans". These include not only WWII veterans, but also citizens who performed combat missions on the territory of the USSR, the Russian Federation and other states at different times, for example:

      who worked in Afghanistan during active hostilities;

      involved in the process of demining the territories of the USSR and neighboring countries in the post-war years (1945-1951);

      performing tasks in the conditions of the armed conflict in the Chechen Republic and adjacent territories (1994-1996), etc.

    The EDV for combat veterans in 2018 can be obtained by contacting the territorial office of the Pension Fund of the Russian Federation, located at the place of registration, and presenting the following documents:

      identity card - passport;

      a certificate confirming the status of a combat veteran;

      certificate of registration at the place of residence.

    An application for a EVD can be submitted to the Pension Fund through the organization's website or written in person. It is under consideration by employees for 10 days after which a response is received confirming the right to receive or refuse with the reasons that served to make such a decision. If a military pensioner does not agree with the decision of the territorial body, then he can appeal the decision to the FIU.

    Disabled

    People with disabilities are given the choice of whether to receive the EVA in 2018 in cash or in kind. The decision can be changed upon re-applying. Additionally, disabled people of groups 2 and 3 are offered the following subsidies:

    A disabled person can use the right to receive a EVD immediately after assigning a group. To receive payment, you must submit an application along with copies of documents:

      passport of the citizen applying for the payment. Birth certificate of a child who has received a disability, if he is under 14 years old, and compensation is issued to him;

      an extract confirming that the applicant has a group;

      passport and power of attorney to transfer the documents of the representative, if the disabled person is not able to come to a personal appointment with the pension fund;

    The payment of benefits is made from the date of application. The standard processing time is 10 days. If a positive decision is made, then an account is opened for the applicant or his official (or money is transferred to an existing pension account). Otherwise, fund employees must notify the refusal within 5 days from the date of the decision.

    Residents of besieged Leningrad

    People who lived in Leningrad during the blockade are entitled to special subsidies. In 2018, blockade survivors are entitled to EDV provided that they have been on the territory of Leningrad (now St. Petersburg) and adjacent territories for at least 4 months from September 8, 1941 to January 27, 1944. The powers to assign various social payments have been transferred to the competence of regional authorities since 2005. Pension supplements are an optional form of assistance, and in some areas they simply do not exist. How much is a labor veteran paid monthly and what is the procedure for processing such a payment?

Definition of EVD, what laws govern it

A monthly cash payment is a way for the state to support its citizens belonging to certain categories. In some cases, the EVD supplements a set of other benefits, sometimes replaces them - if the recipient wishes.

The size depends on the category to which the citizen belongs. The accrual procedure and requirements for recipients are specified in the relevant laws. At the federal level, there is a law for labor veterans. Each region supplements this main normative act with the results of local lawmaking.

Measures to support the disabled are contained in the law; persons affected by radiation due to the Chernobyl accident - in; citizens with the rank of Hero, holder of the Order of Glory - in FZ-4301-1 of 1993. Heroes of labor receive EVD on the basis of amendments to, adopted in 1997.

Who is assigned

Veterans of the Great Patriotic War who became disabled were awarded an increased amount of EDV and an additional amount (DEMO). From 2019, the payment to veterans will amount to 3,911.87 rubles, and to disabled veterans - 5,215.84 rubles. DEMO - 500 or 1000 rubles. WBD can count on 2869.72 rubles. since 2019.

Monthly payments to labor veterans of federal significance in 2019 amount to 712 rubles. But for workers at the regional level, payments are assigned in the regions, and their amount depends on the possibilities of the local budget and decisions of the authorities.

Disabled people receive EVD depending on the severity of the disease or injury. In the first group, the amount will be 3,626.98 rubles, in the second, including children with disabilities, - 2,590.24 rubles, and those in the third group will receive 2,073.51 rubles a month.

If the disabled person was in a concentration camp, the payment to him will be 5180.46 rubles. Other prisoners of concentration camps are entitled to the amount of 3885.33 rubles.

Victims of radiation, depending on the severity of the consequences, will receive a monthly supplement from 518.37 to 2590.24 rubles. If the UDV is also possible on another basis, then in this case both payments are summed up.

How to issue

The assignment of payments is declarative in nature. Pensioners of all categories, except for labor veterans of regional significance, apply to the Pension Fund of the Russian Federation at the place of residence or registration. If the pension is already being paid, then you should contact the same department where it was assigned.

The legal representative of the pensioner can also submit an application and a package of documents. The paperwork you will need is as follows:

  1. Identification.
  2. Registration documents.
  3. Certificate of title (belonging to one or another preferential category).

Within 15 days, of which 10 is given to the state body to make a decision, and 5 to notify the pensioner, a payment is assigned. In some cases, up to 30 days are allotted for the procedure for assigning monthly payments to labor veterans.

Labor veterans of the region provide the same information, only to the social security authorities at the place of residence.

Accrual and indexation

The monthly allowance indexation rules state that, based on the inflation rate forecast, from April 1, there should be an annual increase in the amount. This continued until 2016, when the order was changed, and there was no increase at all.

In 2019, when determining the need to increase the amount of the CMU for labor veterans, the level of price increases in 2017 was taken into account. And the increase itself is scheduled not for April, but for February 1. Its size is 2.5%.

As a rule, the EVD is issued on the day of payment of the pension in the same way: on a card, through the post office, and so on. But this order can be changed by writing an application and indicating a new method of receiving money.

In some regions, the payment is not provided. There is only a set of social services. Legislatively, the appointment of the EDV to labor veterans is a right, not an obligation of local authorities, as well as an increase in its size.

In 2019, federal labor veterans are paid UDV regardless of the pensioner's place of residence. Whereas honorary workers of the region receive an additional payment only at the place of residence and destination.

What is NSU

Another way to support special categories of pensioners is the NSO. This is a set of social services that are provided at the expense of the budget. This includes: medical care in terms of providing medicines and products, in some types of urban and suburban transport, health improvement in sanatoriums, use of a city telephone, radio station, and others. The list is different for each region.

Thanks to monetization, you can opt out of NSO in whole or in part and receive an amount that will increase your monthly payment. To do this, you need to submit an application for a waiver before October 1 of the current year so that it comes into force next year.
